International Arbitration
Arbitration as a type of alternative dispute resolution for parties to resolve their dispute in an out of court procedure is gaining in popularity and effectiveness as of late.
Through experience we have learned that the outcome of international disputes is often determined by a well-drafted dispute resolution clause in the business contract. When a dispute arises an arbitration agreement will need to be drafted if parties wish to proceed with an ad hoc arbitration and decide themselves on all aspects of the arbitration. Otherwise, parties may refer in the arbitration clause to an already established body such as London Court of International Arbitration (LCIA) or International Chamber of Commerce (ICC) which provide such agreements. NCI Law Group offers clients assistance, representation and advice at all stages of the arbitration process including pre-arbitral negotiations, the conduct of arbitral proceedings and advocacy at trial.
Cyprus, both by itself but also as a member of the EU has an established legal and regulatory framework to a very attractive venue for such arbitral proceedings. The Chartered Institute of Arbitrators has also an active branch in Cyprus and all international conventions are applicable and followed. Cyprus amongst others was one of the first countries to recognize and sign international instruments such as the New York Convention (NYC) on the recognition and enforcement of foreign arbitral awards and UNCITRAL. Therefore, it offers easy access from worldwide destinations, it is a cost-effective and reliable place for arbitration, it offers several venues depending on the size and type of the arbitration and it is compelled to enforce arbitral awards under national and international law.

Banking License
The banking sector is an evolving, ever-changing but permanent part of the international and national economic regime. A banking license is a prerequisite for any financial institution that wants to provide banking services. Any business activities carried on without the required authorization are subject to prosecution as provided in the relevant governing laws.
The process of applying for a banking license is often a complex and long one. An applicant will have to complete a comprehensive set of application forms and provide the regulator with a full set of supporting documents such as business plan, risk management policy statements, compliance manuals and procedures and other information. Each country negotiates their licenses differently. In many jurisdictions it is both difficult and financially restrictive for many people to own a bank.
With the economic crisis hitting Cyprus and its banking sector the new enhanced regulatory framework implemented created new opportunities for foreign banking service providers to establish their presence in Cyprus. Cyprus due to its strong shipping position, its upcoming position as energy source and still attractive tax and legal regime as regards to companies, is an extremely beneficial destination. The procedure, policy and approval for a banking license are determined by the Central Bank. In general there are three available licenses In general there are three available licenses a license to perform banking business and provide services; license for establishment in Cyprus of a representative office of an institution already licensed to carry on business under the laws of another country and license for the provision of cross border services and establishment of branches of a bank licensed in an EU member state.
