Probate
Probate is the first step in the legal process of administering the estate of a deceased person whereby all claims are resolved so that distribution of the deceased’s property under will or not can occur. It is the legal process required to be completed when someone dies leaving behind property or assets.
In such cases an application needs to be filed to the court to open a probate case. If there is a Will this is done by the person named as executor otherwise the family of the deceased can petition the court.
